Participant Agreement, Release of All Claims & Assumption of Risk

I acknowledge that participating in Jetcar and Personal Watercraft activities entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, property, or third parties — risks that cannot be eliminated without jeopardizing the essential qualities of the activity. Risks include but are not limited to: slips and falls; being jolted, jarred, bounced, thrown about or shaken during rides; collision with fixed or movable objects, vehicles or other watercraft; capsize and entrapment; accidental drowning; slippery wet craft; forces of nature including weather extremes, lightning, wind, cold, waves, eddies, tidal conditions, surf and currents; cold-water shock, hypothermia, heat illness, sunburn, dehydration; dangerous marine and plant life; sprains, fractures, lacerations and internal injuries; equipment failure and/or operator error; and the negligence of other participants.

I expressly assume all risk

My participation is purely voluntary. I agree to wear a U.S. Coast Guard–approved personal flotation device at all times. I voluntarily release, forever discharge, and agree to indemnify and hold harmless Exotic Watersport Rentals LLC and its agents, owners, officers, employees and volunteers ("EWR") from any and all claims connected with my participation, including claims that allege negligent acts or omissions of EWR.

Governing law

Any lawsuit shall be brought solely in the State of Florida under Florida law. If any portion of this agreement is found unenforceable, the remainder remains in full force. This document is valid for subsequent visits and participation at EWR.

Protective Wetsuit Advisory

I have been advised to wear properly fitted wetsuit bottoms or equivalent protection to guard against injuries caused by water forced into body cavities near the jet thrust nozzle. I understand the risks of declining this precaution.

Bareboat Rental Agreement & Safety

I confirm I am the renter/operator, that I will obey all USCG navigation rules, speed and no-wake zones, capacity limits and posted instructions; that I will not operate under the influence of alcohol or drugs; and that I am financially responsible for damage to the vessel during my rental per the bareboat rental agreement.
